The State Concern "Turkmenhimiya" filed a lawsuit with the Arbitration Court at the Stockholm Chamber of Commerce over Belgochimprom OJSC's failure to fulfill its obligations under the contract for the construction of the Garlyk potash mining complex.
The fact is that back in 2009, Belgohimprom began the construction of a potash mining complex in Turkmenistan. The completion of the work and the delivery of the work object according to the contract was to be held in January 2015. Turkmenistan throughout the entire time regularly fulfilled its obligations, ensured timely payment of work, the Belarusian organization did not meet the deadline and asked the Turkmen side to extend the deadline until March 2017. Extended. But by this date they did not manage to complete it.
The Government of Belarus, aware of the unavailability of the facility, nevertheless appealed to Turkmenistan with a request to accept the plant on March 31, 2017, and all deficiencies by Belarusians will be eliminated within a year in accordance with an additional agreement. The Turkmens went forward and on the last day of March 2017 by the Presidents of the two countries and the acceptance committee, the complex was inaugurated.The complex was opened, but the deficiencies remained. Because of them, the design capacity of the enterprise of 350 thousand tons of products has not been achieved, moreover, the complex operates less than 5% of the capacity declared by the contractor. There have been no and no answers to the Turkmen’s numerous appeals to address the shortcomings of the Belarusian side. It was then that they decided to terminate the contract and go to court. The Belarusians, represented by President Lukashenko, only stated that Turkmenistan did not transfer money for the construction of the complex, and now they will understand who is to whom the Rabinovich.
